Question: Is every will subject to probate through the surrogate's court system?
Answer: No.
You must probate a will only if you have more than $20,000.00 worth of assets in your own name upon your death. These assets do not include jointly held property, bank accounts that are held in trust for another individual, IRA's that designate beneficiaries or insurance policies that direct who receives the life insurance proceeds upon your death.
